GENERAL
VISITOR TERMS

These General Visitor Terms and Conditions apply to agreements concluded with visitors of events organised by or on behalf of Evoque (hereinafter referred to as the "Organizer").


ARTICLE 1 | DEFINITIONS

ORGANIZER: Evoque, the company with which the Visitor has entered into an Agreement regarding attendance at an Event.

CUSTOMER: any natural person or business entity (company) that, directly or indirectly, concludes an Agreement with the Organizer through the (Pre)sales Outlet and/or regarding attendance at the Event, including but not limited to Visitors.

VISITOR: any natural person, whether or not acting in a professional or commercial capacity, who directly or indirectly enters into an Agreement with the Organizer in their capacity as Customer for the purpose of attending the Event, as well as any (other) person who is actually present in or around the Event Location for that purpose.

EVENT: a one- or multi-day happening, including a (music) performance and/or other manifestation, concert, dance event, cultural event, business event, festival, and possibly accompanying camping facilities and/or a public or private event, indoors and/or outdoors, in which one or more persons participate, organised and/or facilitated by or on behalf of the Organizer at the Event Location.
EVENT LOCATION: location(s) where an Event takes place, also referred to as the "Venue", deployed for the purpose of organising and/or facilitating the Event by or on behalf of the Organizer, including any Camping Site.

VISITOR TERMS: these General Visitor Terms.

AGREEMENT: any direct agreement between the Customer and Organizer and/or agreement resulting from the Visitor Terms in connection with the purchase of Admission Tickets and/or attending an Event, as well as any other provision or expression declared applicable to the legal relationship between the Customer and Organizer in accordance with these Visitor Terms.

PRIVACY STATEMENT: the privacy statement outlining the Organizer’s privacy policy, accessible on the Website(s) and applicable to any processing of personal data by or on behalf of the Organizer.
SOCIAL MEDIA: the social media channels specifically affiliated with the Website(s) and other (promotional) expressions of or on behalf of the Organizer registered in the name of or on behalf of the Organizer.

(PRE)SALES OUTLET: a sales outlet engaged by the Organizer for the sale of Event tickets, including those where tickets can be purchased online/digitally.

ADMISSION TICKET: a validly obtained proof provided by or on behalf of the Organizer indicating the Visitor’s authority to be present at the Event Location during the Event, which may consist of a document, barcode, or wristband after exchange.

ADMISSION PRICE: the official relevant purchase price for an Admission Ticket, excluding any additional service fees, handling fees, administration fees and/or membership fees.

WEBSITE(S): the website(s) of the Organizer and any specific affiliated website(s) and Social Media accounts related to the Event(s), including any special apps linked to them operated by or on behalf of the Organizer.


ARTICLE 2 | APPLICABILITY

2.1 These Visitor Terms apply to any Agreement concluded between Organizer and the Customer regardless of how this Agreement is concluded, as well as to any visit by the Visitor to the Event Location during the Event.

2.2 The Customer purchasing the Admission Ticket is obliged to impose these Visitor Terms on the natural person to whom the Ticket is made available. The Customer must ensure that this Visitor complies with the Visitor Terms and remains liable for any non-compliance by that Visitor.

2.3 Organizer reserves the right to amend these Visitor Terms in whole or in part at any time. Changes will be communicated via the Website(s). If the Customer considers the changes unreasonable, they must notify Organizer in writing within ten (10) working days after publication. Otherwise, the changes are deemed accepted.

2.4 The applicability of any general terms and conditions of the Customer is expressly rejected unless explicitly accepted in writing by the Organizer.

2.5 The invalidity of any provision of these Visitor Terms does not affect the validity of the remaining provisions.

2.6 In addition to these Visitor Terms, the terms and conditions of the ticket provider may apply to the purchase of an Admission Ticket.

2.7 The Agreement and these Visitor Terms are exclusively governed by Dutch law. Any disputes shall be submitted exclusively to the competent court in Amsterdam, the Netherlands.


ARTICLE 3 | OFFERS AND CONCLUSION OF AGREEMENT

3.1 Information, offers, announcements, and price quotations regarding Events and/or Admission Tickets are provided as accurately as possible by Organizer and/or third parties. Organizer accepts no liability for inaccuracies or incompleteness.

3.2 An Agreement is concluded at the moment the Customer purchases an Admission Ticket from Organizer or an authorised (Pre)sales Outlet, accepts an offer from Organizer, or enters the Event Location during the Event.

3.3 The statutory right of withdrawal (cooling-off period) does not apply to Admission Ticket purchases. Cancellation within fourteen (14) days is therefore not possible.


ARTICLE 4 | ACCESS AND ADMISSION TICKET

4.1 Visitors must carry a valid identification document and valid Admission Ticket at all times and present these upon request. If access is restricted to persons aged 18 and over, entry will be denied without refund if the Visitor does not meet this requirement unless explicitly stated otherwise.

4.2 An Admission Ticket grants one-time access to the Event and automatically loses validity upon leaving the Event Location unless otherwise specified.

4.3 If an Event is rescheduled, the Admission Ticket remains valid for the new date. Visitors unable or unwilling to attend may request a refund of the Admission Price only. Additional fees are non-refundable.

4.4 Admission Tickets remain the property of the Organizer and grant access only to the legitimate holder.

4.5 Admission Tickets may consist of a document, barcode, or wristband issued by or on behalf of the Organizer.

4.6 Admission tickets remain sealed and non-transferable until seventy-two (72) hours prior to the start of the Event. Within this period, resale is permitted only through verified platforms such as TicketSwap, Tixel, or comparable services. Outside this window, tickets may only be transferred privately (e.g. to relatives). The original buyer remains responsible for correct transfer. Organizer accepts no liability for disputes arising from private resale.
Alternatively, ticket holders may request a swap to another Event organised by Evoque already announced and on sale, subject to approval and possible additional payment depending on price differences.

4.7 By purchasing an Admission Ticket, the Visitor confirms the ticket is intended solely for personal attendance. Tickets may not be acquired for resale or distribution that disrupts fair ticket allocation. Violations may result in cancellation without refund.


ARTICLE 5 | PROHIBITION OF RESELLING TICKETS

5.1 It is prohibited to resell, offer for sale, or distribute Admission Tickets commercially without permission from the Organizer.

5.2 Customers are not permitted to advertise or conduct publicity relating to the Event without prior written consent from the Organizer.

5.3 If a ticket is transferred free of charge, the transferring Visitor must ensure the recipient complies with these Visitor Terms.

5.4 Violations may result in invalidation of tickets, denial of entry, removal from the Event Location, and a penalty of €100 per ticket per day without prejudice to further claims.

5.5 All intellectual property rights relating to the Event and associated branding remain exclusively with the Organizer. Unauthorized reproduction or use is prohibited.


ARTICLE 6 | LIABILITY

6.1 Attendance at the Event and presence at the Event Location are entirely at the Visitor’s own risk.

6.2 Organizer excludes liability for damages resulting from cancellation, modification, relocation, or other circumstances related to the Event unless caused by intent or gross negligence.

6.3 Organizer is not liable for changes to Event programming, content, or duration.

6.4 Organizer is not liable for injury, loss, or damage incurred during attendance except in cases of intent or gross negligence.

6.5 Organizer excludes liability for loss or damage to personal belongings unless caused by proven intent or gross negligence, with compensation capped at €250 upon valid proof of purchase.

6.6 Found items must be handed to staff. Items will be retained for two weeks after the Event.

6.7 Loud music may be played. Visitors are advised to use hearing protection.


ARTICLE 7 | CANCELLATION, RELOCATION AND FORCE MAJEURE

7.1 Organizer may change parts of an Event. Only full cancellation entitles the original ticket purchaser to a refund of the Admission Price.

7.2 Visitors are responsible for checking whether an Event is cancelled or relocated. Organizer will make reasonable efforts to inform Visitors but cannot guarantee timely notification.

7.3 Tickets remain valid for relocated Events unless otherwise stated.

7.4 If rescheduled due to force majeure, tickets remain valid. Refund of Admission Price is possible if attendance is no longer feasible.

7.5 Force majeure includes circumstances beyond Organizer’s control preventing fulfilment of obligations.

7.6 Examples include strikes, illness, transport disruption, power failures, legislation changes, natural disasters, terrorism, pandemics, and government restrictions.


ARTICLE 8 | EVENT HOUSE RULES

8.1 House Rules apply at all Events and Event Locations. Non-compliance may result in removal without refund.

8.2 Professional recording of the Event without permission is prohibited. Personal recordings may only be used privately.

8.3 Organizer may record audio and visual material during Events. Visitors grant permission for use of their image, voice, and likeness worldwide and indefinitely without compensation.

8.4 In case of No Phone Policy Events, additional restrictions may apply. Visitors requiring phones for medical reasons must notify Organizer in advance.

Visitors who violate phone restrictions after warnings may be removed from the Event or denied entry to future Events.

These General Visitor Terms and Conditions apply to agreements concluded with visitors of Events organised by or on behalf of Evoque.
